Terms of use

What you may expect from DeepWork, and what is left to you. Use it at your own risk: it is free, it carries no account, and no claim of any kind is accepted.

Covers this website and the DeepWork app

The short version

Use DeepWork entirely at your own risk. It is free, nothing is charged, nothing is taken and there is no account. No claim of any kind is accepted if something goes wrong.

There is no warranty and no promise to add a feature, fix a fault or keep anything working. Whatever you do with it is yours — your decisions, your data and your backups. If that is not acceptable to you, do not use it.

What these terms cover

These terms are the agreement between you and me for the DeepWork website at deepwork.rajatmalik.dev, the web app at app.deepwork.rajatmalik.dev, and the desktop builds published on the project's release page.

They do not replace the software licence described below, and they do not govern any other site you reach by following a link from here.

Use at your own risk

Everything here — this website, the web app and the desktop builds — is used entirely at your own risk. Whatever you do with it is your own decision and your own responsibility.

I accept no claim, of any kind, from anyone, for anything connected with DeepWork: not for lost data, lost work or lost time; not for a reminder that did not arrive or a number that did not add up; not for a decision you took because of what the app showed you; not for damage to a device, a file or an installation; and not for an improvement, a feature or a fix that is asked for and not delivered. There is no obligation to answer, to fix, to improve or to keep anything working.

If something is wrong, tell me. I read it, and I fix what I can — as a courtesy, not an obligation, and it creates no claim. The formal limitation is under Liability.

Who runs DeepWork

DeepWork is a personal open-source project by Rajat Malik, based in Gurgaon, India. It is not a company and it has no staff. Where these terms say "I", that is who is meant.

Licence

The DeepWork application is released under the MIT licence. Read the full text at the repository's LICENSE file. In short: you may read the source, change it, and ship your own version — including commercially — provided the copyright notice and the licence travel with it.

The text, design and code of this website are © Rajat Malik and are not covered by that licence. You are welcome to quote from it and link to it; wholesale republication is not.

The licence grants no rights to the DeepWork name, the mark or the visual identity. A modified build should carry a different name, so that nobody mistakes it for the release published here.

Free, with no account

Nothing is charged, at any time, for anything. There is no price, no subscription, no trial, no in-app purchase, no card to enter and no account to create. Nothing is taken from you: not money, not your work, not your identity.

Because nothing is paid for, there is no service level: no promised uptime, no promised response time, no promised roadmap and no obligation to add a feature, fix a fault or answer a message. The site and the downloads are served by GitHub, so an outage there is an outage here, and I cannot do anything about it beyond waiting.

Provided as it is

DeepWork is provided "as is", without warranty of any kind, express or implied — including, to the extent the law allows, any warranty of merchantability, fitness for a particular purpose or non-infringement. That is the same disclaimer the MIT licence carries.

It runs on your own machine, so I cannot see your installation and cannot recover your data for you.

Keep backups. The desktop app copies its database into a backups folder before migrations run, and a full JSON backup is the way to move your work to another machine or restore it. If that file is lost and no backup exists, the data is gone — no server holds a second copy.

Not professional advice

The water reminder, the session and break lengths, and the written readings in Insights are habit aids computed from your own entries. They are not medical, psychological, dietary or professional advice, and they are not a diagnosis of anything.

Where a reminder, a break prompt or a reading conflicts with an instruction from a clinician, follow the clinician. If you have a condition that makes hydration or sitting patterns a medical matter, set the app up with that advice in front of you.

Acceptable use

Use DeepWork lawfully. In particular, do not:

  • use the site, the downloads or the issue tracker to break the law or to infringe someone else's rights;
  • attack or overload the site, the downloads or the services that carry them — including scraping that puts a load on GitHub's infrastructure;
  • use the contact form or the issue tracker to send unlawful, abusive or automated bulk messages;
  • present a modified build, or a fork, as the official DeepWork release, or in a way that suggests I endorse it.

Third-party services

GitHub hosts this site, the downloads and the issue tracker. GoatCounter counts visits. If the contact form is later given a form-handling service, that service will be named on the form and in the privacy policy. Each of them acts under its own terms, and a link to another site is not an endorsement of it.

Changes

The app changes: the site describes version 3.0.0, and a later release may change, rename or remove a feature. A change that breaks something you relied on is possible, and is not a breach of these terms.

These terms may change too. The date at the top changes when they do, and the change is described here. Continuing to use the site or the app after a change means accepting the new version.

Liability

No claim of any kind is accepted. To the fullest extent the law allows, I am not liable for any loss or damage arising from DeepWork or from anything connected with it — direct or indirect, incidental or consequential, foreseeable or not — including lost data, lost work, lost time, lost profit, a missed reminder, a missed appointment, or the cost of a replacement tool.

The total liability for any claim is limited to the amount you paid for the software, which is nothing, because nothing is charged.

Nothing here excludes a liability the law does not let anyone exclude, including liability for death or personal injury caused by negligence, or for fraud. If a law that applies to you does not allow part of this section, that part does not apply — the rest still does.

Governing law

These terms are governed by the laws of India, and the courts at Gurgaon, Haryana have jurisdiction over any dispute that arises from them.
